These Terms are between you and Magic OT Bug Adventures LLC (“we”, “us”) and cover your use of The Magic OT Bug iPad app (“the App”).
1. Agreement
By downloading or using the App, you agree to these Terms. The App is meant to be set up and managed by a parent, guardian, therapist or educator (a “Grown-Up”) for a child. If you do not agree, please do not use the App.
2. Your license (Apple’s Standard EULA)
The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to the Standard EULA; if the two conflict about your license to use the App, the Standard EULA controls. You may not copy, modify, reverse-engineer, resell or redistribute the App or its content except as the Standard EULA or the law allows.
3. Practice and play, not medical advice
The App offers activities, designed by pediatric occupational therapists, for practicing fine motor, handwriting, visual perception, coordination and following-directions skills. It is an educational and practice aid. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for evaluation or care by a qualified professional. Always rely on a licensed clinician’s judgment for clinical decisions.
4. Children’s use and supervision
The App is made for children, used with a Grown-Up’s supervision. Purchases, settings, external links, sharing and the data tools sit behind a parental gate. Grown-Ups are responsible for supervising a child’s use of the iPad and the App.
5. Privacy
Our Privacy Policy explains how information is handled. In short: the App collects no personal information from children or anyone else, and stores its activity data only on your iPad.
6. Subscriptions, free trials and cancellation
The App is free to download. Its games and activities, and the Professional tools for therapists, are unlocked by optional auto-renewing subscriptions sold through the Apple App Store:
- Magic Circle (monthly or yearly) unlocks the games and Magic Quests and the growth screens in the Grown-Up Portal. It can be shared with your family through Apple’s Family Sharing.
- Professional (monthly or yearly) adds the therapist tools and includes Magic Circle. It is for one professional and is not shared through Family Sharing.
Prices. The price for your country is shown in the App and by Apple before you buy. Prices may differ between countries and may change; Apple notifies subscribers of price changes as its rules require.
Payment. Apple processes all payments. Payment is charged to your Apple Account when you confirm the purchase or, if you start a free trial, when the trial ends.
Free trials. Where offered, free trials are for eligible new subscribers, one per Apple Account across both memberships. Unless you cancel at least 24 hours before a free trial ends, it converts to a paid subscription.
Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged for renewal within the 24 hours before the period ends.
Cancelling. You can manage or cancel a subscription at any time in the iPad’s Settings → [your name] → Subscriptions, or in your App Store account settings. Deleting the App does not cancel a subscription. After cancelling, you keep access until the end of the period you have paid for.
Refunds. Refunds are handled by Apple under Apple’s policies; you can request one at reportaproblem.apple.com.
Restoring. To restore a subscription on a new or reset iPad, use “Restore purchases” in Grown-Up Portal → Settings.
If we offer licenses to clinics or schools, those licenses will be governed by a separate agreement provided with them.
7. Changes to the App
We work to improve the App and may add, change or remove games, activities and features over time.
8. What your child makes
Drawings, writing and other things made in the App stay on your iPad and are yours. We do not receive them and claim no rights in them.
9. Intellectual property
The App, its characters (including the ladybug mascot), artwork, audio, activity designs and other content are owned by Magic OT Bug Adventures LLC or its licensors and are protected by law. All rights not expressly granted are reserved.
10. Acceptable use
Do not use the App unlawfully, try to get around the parental gate or purchase controls, or interfere with the App’s operation or security.
11. Disclaimers
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App will be error-free or uninterrupted.
12. Limitation of liability
To the fullest extent permitted by law, Magic OT Bug Adventures LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the App. Some places do not allow certain limitations, so some of the above may not apply to you.
13. Apple
These Terms are between you and Magic OT Bug Adventures LLC, not Apple. Apple is not responsible for the App or its content. Questions about the App come to us; questions about payments and refunds go to Apple.
14. Changes to these Terms
We may update these Terms. We will post the new version on this page with a new effective date and, for material changes, give notice on this website before they take effect. Continuing to use the App after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules.
